BEGIN DISTILLING – TERMS OF SALE

By using this website you agree to be bound by these Terms.  The Terms apply to all users of this website, and any and all other online or digital platforms (including without limitation mobile and other applications, such as Facebook apps) which are maintained by BeGin Distilling (our “WebSite”, “Site”).

Please read these terms of use carefully. If you do not accept these Terms, then please refrain from using this website.

 

Social Responsibility

We are extremely proud of our high quality brand, products and marketing. As part of our commitment to responsible marketing, we comply with the social responsibility policies.

1. Ordering

1.1. BeGin Distilling requires all Website customers to register with a valid email address in order to purchase. By registering, you agree that BeGin Distilling can contact you regarding your order through your email address. Such communications include email confirmations and updates regarding your order.

1.2.  If you make a purchase through the Website, BeGin Distilling requests information from you in the BeGin Distilling checkout process, including contact information (like name and contact number) and financial information (name, credit card number, expiration date, and security code). If BeGin Distilling has trouble processing your order, this contact information is used to get in touch with you. Financial information is taken in a secure area, is encrypted for BeGin Distilling customers’ protection, and is not sold or shared with anyone else under any circumstances.

1.3.  The order total includes the price of the product(s) ordered and GST. Prices displayed on this Website accurately reflect real-time store prices of the selected BeGin Distilling store at the time of display. BeGin Distilling reserves the right to update prices at any time, which may update real time prices at checkout. Prices may also vary between BeGin Distilling sellers.

1.4.  Acceptance of any order placed through this Website is conditional on either validation of the credit card number you provide to us and approval of the purchase amount by the card issuer, or validation of credit available for debtor accounts. BeGin Distilling stores reserve the right to not fulfil orders whereby the debtor account has exceeded the credit limit. All transactions are billed in New Zealand dollars.

2. Delivery

2.1.  In accordance with legislation, the BeGin Distilling factory will be closed on Good Friday, Easter Sunday, Christmas Day and until 1pm on Anzac Day. We will not be able to process your order during this period.

2.2.  The product is at your risk as soon as it is delivered to you.  Delivery will be deemed to have been made when it is left at the address nominated in your order, or when a “Card to Call” delivery slip has been left at that premises.  If you are concerned about something going missing or not being left in a suitable place, we do encourage you to request the “Signature Required” delivery service at no extra cost to you.

2.3.  BeGin Distilling supply premium gins and endeavor to ensure that these leave the distillery in good condition.  BeGin Distilling use third parties to deliver the products so please contact us immediately if our product has been damaged in transit.

2.4. BeGin Distilling will make reasonable endeavors to deliver the products to the address nominated in your order within a reasonable time of accepting your order (see the usual delivery time frames).  While BeGin Distilling will endeavor to meet specific delivery date requests, late delivery does not entitle you to cancel any order or part of any order.

2.5.  BeGin Distilling will re-deliver, replace or refund the product (at our option) if the delivery was incorrectly addressed but takes no such responsibility if you gave an incorrect or insufficient address, or if there was no delivery due to the premises having no safe access point.

2.6.  You understand that age verification may be requested upon pick up and BeGin Distilling reserves the right to cancel and refund orders for which age verification has not been provided.

2.6.  Your GST receipt for your order will be given to you at delivery.

3. Cancellations & changes

3.1.  Should you wish to change or cancel your order, you must contact BeGin Distilling as soon as possible.

4. Security
   

4.1.  When our order form asks users to enter sensitive information (e.g. credit card details), this information is encrypted and is protected with the best encryption software in the industry – SSL (Secure Socket Layers). While on a secure page, you will see a locked icon on web browsers such as Mozilla Firefox and Microsoft Internet Explorer, as opposed to unlocked, or no lock icon, during normal browsing.

4.2.  All payments are processed securely via the DPS payment gateway. DPS is committed to data security. DPS uses a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure. 4.3.  Servers that we store personally identifiable information on are kept in a secure environment.

5. Juno Gin Club
   

5.1. Contact Details: It is the responsibility of the purchaser to update Juno Gin with any changes of shipping address. Juno Gin will not replace any mis-placed product due to the customer’s address not being updated.

5.2. Refunds: All Juno Gin Club memberships are final and no refunds are available after purchase. You may transfer your membership to another person at a New Zealand address who is of legal drinking age.

5.3. Timing: You will receive your Extra Fine Juno Gin within three business days of joining the Gin Club. Your seasonal gins will arrive as they are released—this could be in a week or up to three months after your initial sign up (e.g. if you sign up in November). However, if you sign up in the month of a seasonal release, you will be sent that season’s gin immediately upon sign up. Seasonal gins are released in the first week of the following months: February (Summer), April (Autumn), July (Winter), October (Spring). So if you sign up in late January you will receive all four seasonal gins by October that year.

BeGin Distilling uses cookies to tailor information and services for its visitors, to help with navigation and to ensure that BeGin Distilling is able to provide improved service.  A cookie is a small data file sent to your browser which contains information relating directly to your visit to this site.  Cookies track your movements through different sites; they do not record any other personal information about you.  Most browsers automatically accept cookies, but you can change your settings to prevent cookies being stored.  Please note, if you elect not to store cookies, BeGin Distilling will not be able to provide you with the benefits of such.

Most (if not all) BeGin Distilling promotions and competitions have special terms and conditions attached which will apply in conjunction with (and not in substitution for) these terms.  Your entry into any BeGin Distilling promotion or competition will be subject to your acceptance of these terms and any special terms of that promotion or competition.  In the event of any inconsistency between these terms and any special terms and conditions, the special terms and conditions will prevail for the particular promotion or competition.

Indemnity

You agree to indemnify BeGin Distilling, its affiliates and related entities, relevant suppliers, licensors and agents in respect of any loss, damage, cost or expense (including reasonable enforcement costs, whether incurred on a solicitor and own client base or otherwise) suffered or incurred by BeGin Distilling as a result of any inaccurate or incomplete information provided by you to BeGin Distilling or any breach by you of any of your obligations under these terms or any special terms and conditions.

 

Sharing Information

BeGin Distilling may share aggregated demographic information with its partners and advertisers.  Such aggregated information is not linked to any personal information that could identify any person.

 

Governing Law

This site and these terms are governed by the laws of New Zealand.

 

Amendments

BeGin Distilling may amend these terms from time to time. We suggest that you revisit this site periodically to review the current terms.  By continuing to use this site, you are deemed to have agreed to the amended terms.
